Becoming a seller on Denver Online Auctions means joining a community that's growing every day right here in Colorado. But we're more than just an auction platform—we’re a family. We’re a network of estate sale companies from Denver and Colorado Springs that support each other, not compete. When one of us can’t take on a job, we refer clients to each other. We even share staff when someone has a large pick-up and needs an extra hand. We believe that helping others succeed is the key to our own success, and that’s why we’re growing so quickly! Currently, estate sale companies in Denver have very few options for online estate auctions. The available platforms are often expensive, difficult to use, provide poor customer support, and worst of all, require you to offer shipping! We're proud to be the only Colorado-based option that truly understands the needs of our local community!

Our vision is simple: to create a local, one-stop-shop estate sale auction venue for Coloradans. That means more local pick-ups and less shipping (though you can ship if you’d prefer!).

The Platform: After experiencing the challenges of using third-party auction platforms ourselves, we set out to build a better, more user-friendly auction site for both sellers and bidders. Plus, we’ve got some incredible features you won’t find anywhere else—like bulk uploading through a barcode system and an AI tool that uses your photos to generate titles and descriptions. This feature can cut your auction setup time in half!

  • MONTHLY MEMBERSHIP: $18 a month to keep your business page active.  There is a $50 fee if you have no auction in a given month as that is what it costs us to have you on the server.   No commitment, cancel any time.
  • AUCTION FEES: We charge 4% of your month's hammer price, or $75 (per auction) whichever is higher.  You will be charged on the first of each month for the previous month. Example: Your March membership fee and percentage of sales will be charged to your CC on file on April 1st. 
  • FEE TO JOIN - WITH YOUR OWN BUSINESS PAGE:  FREE! (Others charge $250 just to join, making you feel stuck there)!  We want you to try us without feeling stuck! 

 

NEW TO AUCTIONS?  No worries! We’ll provide step-by-step guidance and training, even come to your home (within the Denver or Colorado Springs Metro area), and stay with you until you're fully confident! Offering online auctions to your clients is a great solution for those who prefer to avoid foot traffic in their home, have high-end items, or live in a gated community. Additionally, with the recent increase in break-ins targeting Denver estate sale companies that are forced to make their addresses public, hosting auctions online eliminates that risk almost entirely.

2. Free in-person training on using the software, plus day and evening tech support, 7 days a week.

3. An exclusive Barcode system allows you to bulk upload hundreds of photos in just a few minutes, and they land right in their respective lot number. 

4. A new AI (Artificial Intelligence) button that you can use in each lot after uploading the photos, it will use your photos to create a title and description in seconds.

5. Less restrictions on what you can sell on our platform!  We allow guns (rules apply) and controversial things other sites don't allow.  The only things we restrict are animals, liquor, tobacco, & drugs of any kind.

6. Very user-friendly site for both seller and shopper, and more control for sellers when building auctions.

7. Great accounting printout choices!  One for you which includes totals, taxes collected & buyer's premium, and a separate print out for your client which only lists the items, hammer price & total (and it's editable)!

8. You have the choice to offer a discounted Buyer's Premium for winners who pay cash at pick-up (toggle on/off). When on, the invoice shows both CC price and cash price.  In our case, we have a 15% BP but if paid in cash at pick up, the Buyer's Premium is reduced to 10%.  You pass the savings of CC processing fees on to the buyers.  This is a very popular feature with our shoppers and encourages them to spend more! Again, your choice.

9. You will have your own company page with your own past, current and upcoming sales.  Your sales will also be visible on the Denver Online Auctions home page.  With current and upcoming sales, you are allowed 6 large photos from your auction to show the world exactly what you are offering in your sale.  Other platforms allow 1-3 thumbnail pics.

10. Shipping is made easy (if you ship) with a convenient button to create a shipping invoice and send it directly to the customer which auto-fills with the lot items that will be shipped. 

11. Communication with your buyers goes to YOUR email, not through the auction site, making it more personal with your client and easier to keep track of communication strings. You have the ability to "email all winners" and/or "Text all winners" after an auction closes!  Very convenient for quick communication on, for example, weather related changes for pick-up times, or simply to send a reminder of the pick up days and times.  All invoices have the winning bidder's verified cell phone number on it giving you the power to manage your own business and relationships with bidders!

12. The most important thing, a family!  You will be added to our group message where you can communicate with the owners of all other companies on Denver Online Auctions!  Ask questions, ask for help or advice, etc.  Become part of a community of people who will cheer you on!

SOFTWARE-AS-A-SERVICE AGREEMENT

 

This Subscription Agreement (this "Agreement") is by and between Seller and Denver Online Auctions, LLC.  A Limited Liability Company.

 

1. SERVICES OFFERED

Denver Online Auctions provides Estate Sales Companies with access on a subscription basis to its hosted auction platform, which consists of cloud hosted software-as-a-service applications and an online marketplace (the "Services"). The Services facilitate sellers' interaction with participating bidders. Denver Online Auctions agrees to provide to Seller, and Seller agrees to purchase access on a subscription basis to the Services.  Access to the Services include unlimited auctions and bidding, hosting, free support, and integration of the banking system stripe.com.

 

2. FEES & PAYMENT

The Seller, who is approved as an estate liquidator and/or auction house, agrees to pay (a limited time offer) "zero" set up fee due upon the signing of this Agreement.

There is a monthly fee of $18.00, along with a minimum commission of $75 or 4% of the total hammer price for each auction (whichever is higher). The seller authorizes Denver Online Auctions to charge the credit/debit card on file as outlined. If a seller has no auctions in a given month, the fee for that month will be $50 instead of $18. This is to cover the cost we pay the server to keep you on board.  If seller chooses to leave Denver Online Auction, they may at any time, but will give DOA 30 days to allow billing to run its course.

Fees are taken on the first of each month for the previous month.  Auctions are put into the month in which the closing days fall.  I.e. An auction that starts in January and ends in February will be in the March 1st Accounting.

Buyer's Premium. Seller may charge bidders a "Buyers Premium" on the hammer price of their sales (payable by the respective winning bidder) which will go directly to the Seller. The buyer's premium is not subject to commission fees by Denver Online Auctions.

 

3. PROOF OF BUSINESS

We require that your business be at least registered as a sole proprietorship or better yet, registered with the Colorado Secretary of State as an LLC (Limited Liability Company) and have a Tax ID number.  It is the law to collect taxes on estate sale items.

 

4. DENVER ONLINE AUCTION'S STANDARDS FOR ONLINE AUCTIONS

We want to create a quality auction site with minimum standards to gain & maintain quality registered users!  Here are the expectations:

a. Take several CLEAR pictures of each lot showing all angles of the item/s (minimum of 4 photos per lot)

b. Make sure to point out any and all flaws by either using a pointer in the photos, or clearly mentioning them in the description.

c. Please use good descriptions; the descriptions contain keywords that help buyers searching for specific items. 

d. A successful auction has 50 - 250 lots.  Having less than 50 items (unless very valuable items), leads to an unsuccessful outcome.

e. Be customer service focused and responsive to bidder's questions.

 

5. PROHIBITED / RESTRICTED ITEMS

Denver Online Auctions does not choose the merchandise listed on the site. It is the responsibility of the seller / vendor to know, understand, and adhere to all prevailing federal, state, and local laws and regulations for what may or may not be sold in accordance with the law.

Sellers/vendors attest that the items they are listing do not violate any U.S. laws, policies, or restrictions on items from countries that have restrictions and regulations in place with the US government. Any violation of this policy may result in immediate removal of the lot in question, and/or expulsion from the platform, at the sole discretion of Denver Online Auctions.

 

Denver Online Auctions prohibits/restricts the listing and sale of the following items on the site.

a. Live animals

b. Stolen or illegally gained goods.

c. Illegal items; knock-off / counterfeit goods.

d. Alcohol* & tobacco. (Empty Collectible Liquor bottles are allowed)

e. Prohibited/Illegal substances such as recreational/medicinal Drugs and/or Marijuana.

f. Hazardous and/or radioactive materials.

g. Services* and “alternative” currencies.

e. Misrepresented or stolen Native American antiquities, artifacts, arts & crafts.

f. Motor vehicles without clean titles

 

FIREARMS

**Denver Online Auctions may permit the sale of long guns / hunting rifles / handguns as long as they are part of an estate auction.  Seller MUST follow all applicable Colorado State Laws which frequently change!  As of April 2025, sellers must meet buyer at FFL (Federal Firearm Licensed) gun shop where buyer pays for a background check.  If the background check is passed, the seller may collect the payment (auction invoice) and leave.  The Gun shop will hold the firearm for three days at which time the buyer can return and pick up.  Under no circumstance will assault weapons be permitted on the site.  Antique guns, or old vintage non-working firearms may be sold directly without background check.  

 

6. TERM AND TERMINATION

This Agreement shall commence on the date signed and continue until terminated by either party providing ten (10) days advance written notice to the other party.  Denver Online Auctions may terminate this Agreement immediately if Seller is in default of any of the terms of this Agreement, including not living up to list of standards.  In addition, if seller's auctions are causing Denver Online Auctions to receive more than 2 negative Google reviews, they will be put on probation or terminated immediately.

The Seller agrees to follow all state, regional, and/or jurisdictional auction laws and statutes. Non-compliance with such laws and statutes may be grounds for the immediate termination of access to the Denver Online Auctions portal and forfeiture of their account. The seller agrees to uphold ethical standards and practices of business and auction operations.

Denver Online Auctions may, at its own discretion, terminate this Agreement immediately if Seller fails to uphold said standards and practices.

 

7. INDEMNIFICATION

A. Denver Online Auctions is free of any liability from charges brought against the Seller to the extent the third-party claim alleges the use of the Denver Online Auctions Platform by the Seller infringes any copyright, trade secret, patent, or trademark of any third party.

B. Denver Online Auctions shall have no liability for, and the Seller shall, at its own expense, defend or at its option settle any claims by a third party or governmental authority arising out of Seller's use of the Denver Online Auction platform.

C. Procedures. Each party will notify the other party promptly upon learning of a claim, demand, suit, or proceeding that might give rise to an indemnified loss, and the potentially indemnifying party may control defense and settlement thereof provided it does so diligently, in good faith, and using reasonably experienced counsel with expertise in the relevant field. The potentially indemnified party will reasonably cooperate in such defense and/or settlement at the potentially indemnifying party's request and expense and may participate at its own expense using its own counsel.

 

8. LIMITATION OF LIABILITY

Denver Online Auction's liability to Seller under this Agreement shall be limited to the amounts actually paid hereunder by Seller to Denver Online Auctions for the twelve consecutive month period immediately preceding the date of the subject occurrence. In no event shall Legacies Estate Sales, Inc. or Denver Online Auctions be liable for indirect, incidental, special, or consequential damages, including loss of use, loss of profits or interruption of business.

 

9. GOVERNING LAW

This Agreement shall be construed and enforced in accordance with the laws of the State of Colorado and the parties' consent to exclusive jurisdiction and venue of the state and federal courts in the State of Colorado.

 

10. WARRANTY DISCLAIMER

Seller accepts the Services as-is.  Denver Online Auctions makes no warranties as to the function or use of the Services, whether express, implied, or statutory, including, without limitation, any implied warranties of merchantability or fitness for a particular purpose. The entire risk as to the quality and performance of the Services is with Seller.  Denver Online Auctions does not warrant that the Software will meet Seller's requirements or that the operation of the Software will be uninterrupted or error free.

 

11. BY USING THE DENVER ONLINE AUCTIONS SITE, YOU AGREE THAT YOU:

HAVE READ DENVER ONLINE AUCTIONS' MARKETPLACE TERMS OF USE AND CONDITIONS AND SOFTWARE-AS-A-SERVICE AGREEMENT.

FULLY AND COMPLETELY UNDERSTAND DENVER ONLINE AUCTIONS' MARKETPLACE TERMS OF USE AND CONDITIONS AND THE SOFTWARE-AS-A-SERVICE AGREEMENT.

THE SELLER ACKNOWLEDGES THAT THE UNDERSIGNED IS AN AUTHORIZED REPRESENTATIVE OF SELLER AND HAS READ THIS AGREEMENT, THAT S/HE UNDERSTANDS THIS AGREEMENT, AND UNDERSTANDS THAT BY USING THE SOFTWARE PRODUCT, SELLER AGREES TO BE BOUND BY THE TERMS AND CONDITIONS OF THIS AGREEMENT. SELLER FURTHER AGREES THAT, EXCEPT FOR WRITTEN SEPARATE AGREEMENTS BETWEEN DENVER ONLINE AUCTIONS & SELLER, THIS AGREEMENT IS A COMPLETE AND EXCLUSIVE STATEMENT OF THE RIGHTS AND LIABILITIES OF THE PARTIES.
