Terms and Conditions
By placing a bid on Denver Online Auctions, you, the Buyer, agree to the following Googie Down, LLC terms:
- Registration: A minimum age of 18 years is required to register and place bids on Denver Online Auctions. A valid username, address, phone number, email address and credit card information is required to register. By registering you, the Buyer, agree that you have read and fully understand the “Online Auction Terms and Conditions” and any additional terms, conditions, announcements and communications for specific auctions such as locations, dates, Buyer’s premiums, pick-up instructions, updates/changes etc..
- Bidding: Bidding is a legal agreement between you, the Buyer, Googie Down, LLC and Denver Online Auctions. Registering for an account and bidding on Denver Online Auctions affirms that you, the Buyer, have read, understood, agree, and acknowledge that all bids placed are legally binding contracts between the winner (highest bidder), Googie Down, LLC and Denver Online Auctions and that you, the Buyer, agree to pay for your items before the auction pickup date. Any non-payment is in violation of Googie Down, LLC terms and conditions and will result in suspension or removal of bidding privileges.
- Payments: Denver Online Auctions uses Stripe Credit Card Services (a PCI DSS Qualified Level 1 Security Service Provider) to process and secure online payments. Googie Down, LLC does not accept credit card or cash payments.
- Warrantees: All sales are final. All items are sold as-is with NO warranty of any type expressed or implied as to the condition, completeness, functionality, or fitness for any items. Obvious flaws will be noted in the description and/or shown in the photos. Any absence of flaws doesn't mean that items are in perfect condition. If in doubt, please ask questions and or for more photos. Most auction items are previously used and by no means should bidders expect to see perfection. No sale will be invalidated by reason of bidding remorse, condition, or defects. The Buyer will accept the items or lots as is regardless of known or unknown, visible or not visible, flaws or defects.
- Auction Pick-up: Each auction will have specific pickup dates and times assigned. Unless otherwise state, there will be no alternative pickup dates or times. By bidding, you, the Buyer, agree to pickup your items on the specific pickup date and time. If you, the Buyer, fail to pickup your items by the close of the applicable auction pickup and or make no attempt to contact Googie Down, LLC before the close of the pickup time, you, the Buyer, forfeit all items and will not receive a refund. We do not remove or store items, after auction pickup. Please inspect all items, prior to leaving the auction location to ensure you, the Buyer, have the correct items. No claims or adjustments will be allowed after the items or lots have been removed from the premises.
- Packing & Moving: We do not provide assistance with packing, moving or loading of your items at auction pickup. Buyers that do not bring adequate assistance, tools, appropriate vehicles and or are unable to safely remove items may not be allowed to access the property and may not receive a refund. Be prepared to move your items!
- Personal or Property Damage: Buyers and or moving help removing items assume all risks of damage or loss to persons and property and specifically assume all risks by reason of any defect in or condition of the premises on which the viewing and/or removal is held. Employees, agents and/or Sellers are not responsible for accidents, theft, personal or physical injuries on the premises during pick-up. Buyer specifically releases Googie Down, LLC and Denver Online Auctions from any and all liability thereof.
Googie Down LLC reserves the right to refuse Buyer access to property for disruptive, abusive, distracting
and harmful behaviors. No weapons of any kind are allowed onsite!
